Divorce in New Zealand, the two year rule and how dissolution works

Last updated 4 July 2026. Fees and the October 2025 law change checked at that date. This is general information, not legal advice.

Key takeaways

  • Separating needs no court and no paperwork. Divorce, which the law calls dissolution, needs two years living apart in the usual case, then a $247 application most people do without a lawyer.
  • Getting back together to try again does not reset the clock, as long as the time together totals three months or less and reconciliation was the reason.
  • Since 17 October 2025, someone protected by a final protection order against their spouse can apply for divorce immediately, with no waiting period at all.
  • Divorce only ends the marriage. Property, children and child support are separate processes with their own rules.
  • Separation changes nothing automatically. Your will, your enduring powers of attorney and your beneficiaries all stay exactly as they are until you change them yourself.

New Zealand divorce is deliberately undramatic. Nobody has to prove fault, nobody’s behaviour is on trial, and the paperwork is designed to be done without a lawyer. The two things that surprise people are the waiting period, and how little a divorce actually resolves. This guide covers both, along with the October 2025 law change that removed the waiting period entirely for people protected by a final protection order.

Separation first, divorce later

Separation is a fact, not a filing. The moment one of you communicates that the relationship is over and starts living apart, you are separated, and you can even be separated under the same roof if you genuinely live separate lives, separate rooms, separate finances, separate domestic arrangements.

The date matters more than people realise, because it starts the divorce clock and fixes the point at which relationship property is generally valued. When the date might be argued about later, put it in writing. A separation agreement does double duty here, it records the date and the property deal, and the law treats a separation agreement that has been in force for the two years as evidence of living apart in itself.

What separation does not do is update a single document. Your will still leaves everything to your ex, only a formal court separation order or the final divorce voids those provisions, an informal separation changes nothing. Your enduring power of attorney naming your ex stays fully alive until you revoke it. KiwiSaver and insurance beneficiaries stay put too. Treat the week you separate as the week you update the paperwork.

The two year rule

In the usual case, the ground for divorce is that the marriage has broken down irreconcilably, and the only proof the Family Proceedings Act 1980 accepts is two years of living apart. Whose fault it was is legally irrelevant, and nothing your spouse did or did not do speeds it up or slows it down.

The law leaves room for trying again. You can get back together, on one occasion or several, for up to three months in total without resetting the clock, provided reconciliation was the real reason for it. And in the question people wonder about but rarely ask out loud, the Act says sexual connection alone, without actually resuming life together, does not end the living apart.

Some 7,887 couples completed the process in 2025, up 5 per cent on the year before but still near historic lows at 7.9 divorces per 1,000 existing marriages, according to Stats NZ. Divorce in New Zealand is rarer than the culture assumes.

Divorce without the wait for protection order holders

Since 17 October 2025, the two year wait no longer applies to people protected by a protection order. If you have a final protection order in force against your spouse, one where any appeal rights have run out, you can apply for dissolution immediately, with no living-apart period at all, and a copy of the protection order is sufficient evidence for the ground. Registered overseas protection orders count too. The change recognises that requiring a violence survivor to stay legally bound to their abuser for two years compounded the harm.

The mechanics sit alongside the ordinary process, the Ministry of Justice publishes dedicated application packs for it, and the normal rule that at least one of you must be domiciled in New Zealand still applies. A joint application under this pathway is only possible in the unusual case where each spouse holds a protection order against the other.

If you are in this situation and need support beyond the legal process, Women’s Refuge is on 0800 733 843 and Shine on 0508 744 633, both free, both experienced in exactly this.

Cost and timeframes

The application fee is $247 as at July 2026, per the Ministry of Justice, and the forms are free. If the fee is a genuine hardship, you can apply for a fee waiver, and joint applicants each file their own waiver form. No lawyer is required, and for a straightforward joint application, none is needed.

Timing runs in weeks, not months. A joint application is usually decided by a registrar on the papers, and in that usual case the dissolution order becomes final one month after it is made. If a judge makes the order in undefended proceedings, it is final immediately. Either way, you cannot remarry until the order is final, and yes, people book venues before checking this.

Applying together

If you both agree the marriage is over, use the joint pack on justice.govt.nz. It is a joint application form and an affidavit each, an affidavit being a statement you swear before a lawyer, JP or court registrar, and you do not need to fill them in or swear them together. File them with the fee at the Family Court, a registrar checks the two years, makes the order without a hearing, and the court posts copies to you both. Most joint divorces involve no courtroom and no appearance at all.

Applying alone

One spouse can apply alone using the one-party pack, and the extra step is service. The application must be personally delivered to your spouse, and you cannot be the one who delivers it, a friend, family member or professional process server does it. Your spouse then has 21 days to respond if they are in New Zealand, 30 days from Australia, and 50 days from anywhere else.

Two worries dissolve on inspection. If your spouse cannot be found, you can ask the court for substituted service, serving them another way such as through a relative or by email, once you show you made genuine efforts to locate them. And if they simply refuse to engage, they cannot actually stop the divorce. Once two years apart is established, opposition can slow the process with a hearing, but the outcome is not in doubt.

What divorce does not sort out

The dissolution order ends the marriage and does nothing else. The things people assume it covers each have their own track:

  • Dividing property. The equal-sharing rules and the traps are covered in our relationship property guide, and nothing requires property to be sorted before the divorce, though most couples do.
  • The children. Care arrangements and parenting orders run through their own process, see our care of children guide.
  • Child support. Assessed and collected by Inland Revenue, covered in our child support guide.
  • Spousal maintenance. A separate claim under the Family Proceedings Act where one ex-partner cannot meet reasonable needs, worth a lawyer’s advice if that is your situation.

Overseas marriages and other situations

You can divorce in New Zealand no matter where you married, as long as at least one of you is domiciled here, meaning New Zealand is the place you treat as home. Civil unions dissolve through exactly the same process. New Zealand dissolutions are widely recognised overseas, but if you plan to remarry in another country, check its rules first, and if you divorced overseas, New Zealand generally recognises that too.

Common questions

How long does a divorce take in NZ

Two years of living apart, then weeks. A joint application is typically processed by a registrar without a hearing, and the order becomes final one month after it is made in the usual case.

How much does a divorce cost in NZ

$247 as at July 2026, and the forms are free. A fee waiver exists for genuine hardship. Lawyers are optional for the dissolution itself, most of the legal spend in a separation goes on property and children, not the divorce.

Can I get divorced without waiting two years

Only in one situation. Since 17 October 2025, a person protected by a final protection order against their spouse can apply immediately with no waiting period. For everyone else the two years is absolute, there is no fast lane for agreement, adultery or anything else.

Can my spouse refuse the divorce

They can decline to sign a joint application, which just means you apply alone and have them served. Once two years of living apart is established, they cannot prevent the order, only delay it briefly by requiring a hearing.

Can we be separated while living in the same house

Yes, if you genuinely live apart under the one roof, separate rooms, separate money, separate lives. Expect the affidavits to explain the arrangements, because the registrar has to be satisfied the separation was real.

Do I need a lawyer to get divorced

No. The forms are designed for ordinary people and the Ministry of Justice publishes step-by-step packs. Where a lawyer earns their fee is the property division, a separation agreement, or anything contested about the children.

Where to get free help

Separation is also the moment to update the paperwork that does not update itself, our guides to wills and enduring powers of attorney cover the two that matter most.
